Farrar & Ball reach settlement with Goodyear Tire & Rubber Co.

Farrar & Ball successfully concluded litigation with Goodyear Tire & Rubber Co. The firm represented Maria San Juan and Disney San Juan, age3, in a tire failure incident wherein Miguel San Juan was killed. Mr. San Juan was a loving father and husband. The case was filed in Clark County, Nevada.

On June 23, 2006, Mr. San Juan was traveling to work in his work-issued truck when the left rear tire lost its tread thereby causing the subsequent rollover. Mr. San Juan died shortly thereafter. The accident tire was a Goodyear Load Range E, Unisteel design. Upon investigation, Farrar & Ball learned that in 2000 Goodyear conducted a silent recall on a great number of its load range E designed tires in the wake of an investigation by The National Highway and Safety Administration. NHTSA began an investigation into the load range E tire line after a high number of incident and deaths were reported during the service of Goodyears load range E tires. In the underlying case, Goodyear fought against producing any of the information concerning its silent recall or root cause investigation concerning its load range E tire lines. After numerous motions and depositions, Goodyear was ordered by the Court to produce all the information Plaintiffs sought concerning this issue.

The case was settled three months before trial was to begin. At the urging of Goodyear, Plaintiffs are unable to disclose the settlement amount.
